By accessing, browsing, or using our website and mobile application ("Platform"), you agree to abide by the following Terms and Conditions. You must read, understand, and agree to these Terms before registering or logging in. If you do not agree with these terms, please refrain from using our services.

1. Introduction

Modern Trade Market operates as a classifieds platform that connects buyers and sellers within Kenya. Our platform allows registered users to create accounts, post listings, purchase items, and boost their posts to increase visibility. We are dedicated to providing a secure and efficient marketplace for users, offering a wide range of products and services. By using our services, you agree to comply with the following Terms and Conditions, which govern your interaction with the platform.

2. Acceptance of Terms & End-User License Agreement (EULA)

By creating an account, logging in, or otherwise using the Modern Trade Market Platform (including our iOS and Android mobile applications), you confirm that you have read, understood, and agreed to be legally bound by these Terms and Conditions, which also serve as our End-User License Agreement (EULA).

You must accept these Terms before you are permitted to register or access any features of the Platform. If you do not agree, you must immediately stop using the Platform and uninstall any associated mobile application.

These Terms expressly state the following commitments that all users must uphold:

  • Zero Tolerance for Objectionable Content: Modern Trade Market has a strict zero-tolerance policy toward objectionable, harmful, explicit, abusive, illegal, or offensive content of any kind. Any such content will be removed immediately upon detection or report.
  • Zero Tolerance for Abusive Users: Any user found to be harassing, threatening, bullying, impersonating, or otherwise abusing other users will be suspended or permanently removed from the Platform without prior notice.
  • Compliance with Community Standards: All users agree to engage respectfully and lawfully at all times while using the Platform.

3. User Accounts

In order to access certain features on our platform, such as posting ads or boosting your posts, you must create an account. During the account creation process, you will be required to provide accurate and truthful information. This information includes, but is not limited to, your name, email address, phone number, and any other details necessary for account setup.

As the account holder, you are responsible for maintaining the confidentiality of your account login credentials, including your password. You agree to notify us immediately if you suspect any unauthorized use of your account or if there is any security breach. Failure to maintain the security of your account may result in account suspension or termination.

We reserve the right to suspend or terminate user accounts that violate these Terms and Conditions or engage in activity deemed to be fraudulent or harmful to the platform and its users.

4. User-Generated Content & Content Moderation

Modern Trade Market is a user-generated content platform. Users are solely responsible for the content they post, upload, or share. We are committed to maintaining a safe and respectful environment through active content moderation. The following policies apply to all user-generated content on the Platform:

a) Content Filtering

Modern Trade Market employs automated and manual content filtering systems to detect and remove objectionable content. These systems scan listings, messages, images, and other user-submitted material for violations of these Terms. Content identified as prohibited will be filtered, blocked, or removed before or after publication, at our sole discretion.

b) Flagging Objectionable Content

Every user has the ability and responsibility to flag content they believe to be objectionable, abusive, misleading, or in violation of these Terms. To flag content:

  • Navigate to the listing, comment, or profile you wish to report.
  • Tap or click the "Report" or "Flag" button available on every piece of user-generated content.
  • Select the most appropriate reason for the report (e.g., spam, offensive content, fraud, harassment, illegal item).
  • Submit your report. Our moderation team will review it promptly.

All reports are reviewed by our moderation team. We are committed to acting on all valid reports of objectionable content within 24 hours of receipt. Upon confirmation of a violation, the offending content will be removed and the responsible user's account will be suspended or permanently terminated.

c) Blocking Abusive Users

Users have the right to protect themselves from abusive behavior. Modern Trade Market provides a user blocking mechanism that allows any user to block another user who is behaving abusively, sending spam, or making them feel unsafe. To block a user:

  • Visit the profile of the user you wish to block.
  • Tap or click the "Block User" option in the user's profile menu.
  • Confirm the block action.

When a user is blocked:

  • The blocked user's content is immediately removed from your feed and listings view.
  • The blocked user will no longer be able to contact you or view your listings.
  • Modern Trade Market is automatically notified of the block action and the reason provided. Our moderation team will review the flagged account and may take further action, including suspension or permanent removal.

d) Our 24-Hour Moderation Commitment

Modern Trade Market takes the safety of its community seriously. We commit to the following moderation standards:

  • All reports of objectionable content or abusive users will be reviewed within 24 hours of being submitted.
  • Confirmed violations will result in the immediate removal of the offending content from the Platform.
  • The user responsible for the offending content will be suspended or permanently ejected from the Platform, depending on the severity of the violation.
  • Repeat offenders will receive a permanent ban with no option for reinstatement.

5. Posting Rules

Modern Trade Market allows users to post listings to buy or sell products and services. However, the following actions and content are strictly prohibited on our platform:

a) Scamming

Any fraudulent listings, misleading claims, or attempts to deceive other users will not be tolerated. This includes, but is not limited to, selling counterfeit goods, misrepresenting product details, or engaging in any deceptive practices.

b) Spamming

Posting repetitive, irrelevant, or excessive content with the intent to spam other users is prohibited. This includes posting the same or similar advertisements multiple times or engaging in any activity that disrupts the user experience.

c) Copyright Infringement

Users are prohibited from uploading or selling any content, such as images, videos, or written material, that they do not own or have permission to use. Any violation of copyright laws may result in immediate account suspension or termination.

d) Objectionable or Explicit Content

Users must not post, share, or upload any content that is sexually explicit, graphically violent, hateful, threatening, or otherwise objectionable. Such content will be removed immediately and the responsible account will be actioned accordingly.

6. Prohibited Content & Activities

We do not allow any content or activities that may harm, harass, or deceive other users, violate the law, or disrupt the integrity of the platform. The following content and activities are strictly prohibited:

  • Illegal Goods or Services: Posting or offering for sale any illegal products, services, or activities is strictly prohibited. This includes drugs, weapons, or any other illegal items under Kenyan law.
  • False or Misleading Information: You must not post listings with false, inaccurate, or misleading information that could deceive other users or harm the reputation of our marketplace.
  • Hate Speech, Harassment, or Discrimination: We maintain a safe and inclusive environment for all users. Any content or behavior that promotes hate, discrimination, or harassment based on race, gender, religion, nationality, or other protected categories is not allowed.
  • Objectionable or Abusive Content: Any content that is sexually explicit, violently graphic, or otherwise offensive and objectionable will be removed without notice, and the responsible account will be suspended or terminated.
  • Abusive Behavior Toward Other Users: Threatening, harassing, bullying, impersonating, or otherwise abusing other users is strictly prohibited and will result in immediate account action.
  • Violation of Kenyan Laws: Any activity that violates Kenyan laws or regulations is prohibited. This includes, but is not limited to, activities related to fraud, human trafficking, or money laundering.

7. Boosting & Payments

Modern Trade Market offers users the ability to boost their posts for increased visibility. Boosting a post allows your listing to appear more prominently in search results and helps attract more potential buyers. However, it is important to note that boosting fees are non-refundable unless an error occurs on our part. All payments for boosting must be made through our approved payment methods.

Boosting your posts is optional, but we encourage users to consider this feature if they want greater exposure for their listings. All payments are processed securely, and we take every precaution to protect your financial information. We reserve the right to suspend or cancel any boosted posts if there are violations of our posting rules or terms, including violations related to objectionable content or abusive behavior, without entitlement to a refund.

8. Liability & Disclaimers

Modern Trade Market acts as a platform for users to buy and sell goods or services. However, we do not verify all listings or transactions between users. Therefore, we advise you to exercise caution and perform due diligence when engaging in transactions.

We are not responsible for the content of user-generated listings or any transactions that occur between buyers and sellers. We do not guarantee the accuracy or authenticity of listings or the performance of any seller, and we are not liable for any losses or damages incurred as a result of using the platform. However, we are committed to maintaining a safe environment and will take prompt action against violations upon report.

9. Account Suspension & Termination

We reserve the right to suspend or terminate any user account that:

  • Violates these Terms and Conditions: Any breach of our terms may result in the suspension or termination of your account.
  • Posts Objectionable or Prohibited Content: Accounts that post content violating our community standards will have that content removed and may face immediate suspension or permanent ejection from the Platform.
  • Engages in Abusive Behavior: Users found to be harassing, threatening, or abusing other users will be suspended or permanently banned without prior notice.
  • Engages in Suspicious or Fraudulent Activity: Accounts engaging in activities that raise concerns or appear fraudulent may be suspended or permanently banned.
  • Receives Valid Reports: We take user reports seriously. Accounts subject to valid complaints regarding objectionable content or abusive behavior will be reviewed and actioned within 24 hours.

10. Privacy Policy

We are committed to protecting your privacy. We collect certain personal information, such as your email, phone number, and details of your listings, to enhance your experience on the platform. Your data will not be shared with third parties, except where required by law or as outlined in our Privacy Policy. Information collected in connection with content reports and user blocks may be retained and used for moderation and safety purposes.

11. Governing Law

These Terms and Conditions are governed by the laws of Kenya. Any disputes arising from these terms or your use of the platform shall be resolved exclusively through the courts of Kenya. By using our platform, you consent to the jurisdiction of Kenyan courts in all legal matters.

12. Updates & Changes

Modern Trade Market reserves the right to update or modify these Terms and Conditions at any time. Any updates will be posted on this page, and the "Effective Date" will be updated accordingly. Continued use of our platform after such changes implies your acceptance of the revised terms. Where changes are material, we will notify users via email or an in-app notification.
